Consumer mediation: new obligations for all companies

As from 1 January 2016, all consumers are entitled to free help from a consumer mediator in view of amicably resolving disputes over the execution of a sales or service provision contract by traders. This is an extensive field: it concerns all companies, whatever their size or legal form (from self-employed craftsmen listed in the trade register and the liberal professions to multinationals selling goods and services in France) and all branches of activity.

This new series of obligations arises from the transposition of the European directive of 21 May 2013 on the extrajudicial settlement of consumer disputes, set forth in articles L611-1 and thereafter and R612 and thereafter of the French Consumer Code.
